scope of application

These terms and conditions apply to contracts for the rental of hotel rooms for accommodation, as well as all other services and deliveries provided by the hotel for the guest.

The subletting and re-letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of the hotel, whereby § 540 (1) sentence 2 BGB (German Civil Code) becomes a condition if the guest is not a consumer.

The guest's terms and conditions shall only apply if this has been expressly agreed in writing in advance.

conclusion of contract 

We are delighted to receive your booking at Hotel Deutschherrenhof. Upon ordering/booking rooms, function rooms, packages (all-inclusive deals) or other services, a contract in accordance with the following terms and conditions is concluded between you (the guest) and Hotel Deutschherrenhof after verbal, written or electronic confirmation by the hotel. Any further confirmations requested by the hotel are for internal planning purposes only and are not relevant to the conclusion of the contract.

In the case of an order/booking for several guests, the person placing the order is liable for all guests/participants registered by them and for all liabilities arising from this contract.

If the hotel's reservation confirmation differs from your order/booking in one or more points, the content of the reservation confirmation shall become part of the contract unless you (the guest) object immediately, at the latest upon check-in (acceptance of services).

If the booking is made through an agent (e.g., travel portals such as HRS.de or booking.com), the agent's confirmation to the guest is only auxiliary. The booking may be rejected by Hotel Deutschherrenhof for good cause (overbooking, incorrect rates, etc.).

If Hotel Deutschherrenhof requests a deposit or advance payment for a reservation/booking and this is not made within the agreed period, the reservation/booking shall be deemed to have been canceled.

arrival and departure

Check-in is possible from 3:00 p.m. on the day of arrival. Check-out must be completed by 11:00 a.m. on the day of departure.

If you wish to depart after 11:00 a.m. (late check-out), please inquire at the reception desk. If the Hotel Deutschherrenhof agrees to a late check-out, half the room rate will be charged for departures before 6:00 p.m. and the full room rate for an additional night will be charged for departures after 6:00 p.m. We kindly ask you to arrive by 6 p.m. at the latest for reserved rooms. If no late arrival after 6 p.m. is notified in advance, or if your reservation has not been paid for in full or in part in advance, the Hotel Deutschherrenhof may dispose of the rooms elsewhere.

services

The duration and scope of the contractual services provided by Hotel Deutschherrenhof are based on the information in the currently valid price list, the Hotel Deutschherrenhof website, or the agreements made. Any agreements that deviate from the valid price list must be made between you (the guest) and the hotel and must be confirmed in writing by the hotel. With the publication of a new price list, all previous prices lose their validity.

All offers are subject to change. Offers sent by post, e-mail, or fax are valid for a maximum of 7 days.

Our pampering half-board includes a buffet breakfast and a three-course menu of your choice for dinner. If possible, the Hotel Deutschherrenhof also offers lunch instead of dinner at the guest's request.

If, for whatever reason, the guest does not consume one of the meals, they are not entitled to a refund or reduction. This also applies to pro rata refunds.

The prices stated in the current price list or in other lists and confirmations include service charges and the currently applicable value added tax. Local taxes that are payable by the guest in accordance with the respective municipal law, such as visitor's tax/tourism tax/accommodation tax, are not included.

If there is an increase in VAT after the contract has been concluded, we must pass on this increase. If there are more than 6 months between the conclusion of the contract and the date of arrival, we also reserve the right to make price changes without prior notice.

payment

For group bookings of 10 or more people, the number of rooms must be confirmed 16 weeks before arrival. Five weeks before arrival, a partial invoice for 50% of the total amount will be sent to the customer as a guarantee. The remaining payment must be made upon departure at the latest, unless otherwise agreed in writing between the customer and Hotel Deutschherrenhof.

If no other (advance) payment has been requested by Hotel Deutschherrenhof, the total amount of your booking/reservation is due upon departure.

For stays of more than 5 days, Hotel Deutschherrenhof may issue an interim invoice.

If the guest is in default of payment, the hotel may terminate the agreement with immediate effect. The Hotel Deutschherrenhof reserves the right to claim further damages, in particular the loss of other rentals.

If the guest terminates their stay prematurely, they are still obliged to pay the total amount booked/confirmed. Exceptions to this are excluded, unless the guest can prove that the Hotel Deutschherrenhof has failed to re-let the room at a reasonable price.

The place of performance for the guest's payment obligations is Zeltingen-Rachtig. This also applies if the guest has been credited with the payment.

Payments by credit card companies, checks, or bills of exchange are made only on account of performance.

cancellations and fees

Guests may cancel their trip at any time prior to departure; however, in the guest's own interest, this should be done in writing. Cancellations of reservations are possible under the following conditions:

for individual travellers up to 9 people

• Up to 21 days prior to arrival: free of charge
• Up to 7 days prior to arrival: 60% of the total price
• Up to 1 day before arrival: 80% of the total price
• No-show: 90% and early departure: 100% of the total price 

Group trips for 10 or more people

• Up to 50 days before arrival: free cancellation for the entire group
• Up to 30 days before arrival: 50% of the total amount 
• Up to 14 days before arrival: 80% of the total amount
• After that: 100% of the total amount 

Events for 10 or more people

• Up to 4 weeks before arrival or the start of the event: free of charge
• Up to 20 days before arrival/start: 20% of the total amount
• Up to 10 days before arrival/start: 80% of the total amount
• Up to 3 days before arrival/start – 90% of the total amount
• After that – 100% of the total amount

liability

The guest or organizer is liable to Hotel Deutschherrenhof without proof of fault for any damage caused by them or their guests.

If the guest or contractual partner loses a key, they are liable for the replacement of the locking system.

In the event of a false alarm triggered by the guest or contractual partner, the latter shall be liable for all damages incurred by the hotel as a result (fire department and personnel deployment, etc.).

We cannot accept any liability for food brought in or delivered (e.g., wedding cakes) or food taken from the restaurant.

The Hotel Deutschherrenhof is not liable to the guest or contractual partner if the provision of services becomes impossible in the event of a strike or as a result of force majeure, in particular flooding. In such cases, the Hotel Deutschherrenhof will endeavor to procure equivalent services elsewhere.

The Hotel Deutschherrenhof is liable to the guest in accordance with the provisions of §§ 701 f BGB (up to 100 times the room price, maximum 3,500.00 euros); not for money and valuables, unless the Hotel Deutschherrenhof or its staff is demonstrably at fault, or the valuables or money were left with the Hotel Deutschherrenhof for safekeeping against issuance of a receipt.

If the guest brings a motor vehicle and parks it in a parking space provided by the Hotel Deutschherrenhof, liability is limited to damage that can be proven to have been caused by hotel employees.

In the case of events, it is the responsibility of the contracting party to insure any items brought along against theft, damage, or destruction. The Deutschherrenhof Hotel accepts no liability in this regard.

cancellation

If the guest uses the rooms provided to them for a purpose other than that agreed upon, Hotel Deutschherrenhof shall be entitled to extraordinary termination rights.

If the Hotel Deutschherrenhof has reasonable grounds to believe that a planned guest event jeopardizes the smooth running of the business, the safety or reputation of the hotel or its guests, the hotel may terminate the contractual relationship without notice.

In such cases, the Hotel Deutschherrenhof's claim to the agreed remuneration shall remain valid despite the extraordinary termination.

The hotel also has an extraordinary right of termination in cases of force majeure or internal unrest.

vouchers

Vouchers are redeemable as soon as the corresponding payment has been received in the business account of the Hotel Deutschherrenhof. The original voucher must be presented on arrival. The hotel may refuse service if the voucher is not presented.

miscellaneous

The provision of rooms and other areas is subject to a fee. The provision of these to third parties is only permitted with the written consent of the Hotel Deutschherrenhof.

Animals may only be brought along with the prior consent of the Hotel Deutschherrenhof and subject to a surcharge. Animals are not permitted in the wellness area or other designated areas.

Wake-up calls, information, mail, and goods shipments are provided without obligation. Guests cannot derive any claims of any kind from this. Lost property (items left behind) will only be forwarded on request against reimbursement of shipping costs. The storage period is 6 months.

In the event of free transportation of the guest by the Hotel Deutschherrenhof, liability for personal injury and property damage is limited in accordance with the motor vehicle insurance policy.

Insofar as excursions, transfers, boat and bus trips or other services (e.g. wellness treatments) are provided by a third party on behalf of the Hotel Deutschherrenhof, the latter shall be liable to the guest in accordance with its respective terms and conditions or applicable legal provisions. The liability of the Hotel Deutschherrenhof is excluded in this case.

Bringing food and drinks to events at the Hotel Deutschherrenhof is strictly prohibited. Decorating the event rooms requires a special agreement, unless it is just the usual table decorations.

When registering multiple people, as well as for group, travel, seminar, and conference events, the number of participants and, if applicable, a list of participants' names must be sent to the Hotel Deutschherrenhof at least 3 days before arrival or the start of the event. Political events must be clearly identified in the request.

The communication and advertising of trips connected with a stay at the Hotel Deutschherrenhof requires the prior written approval of the respective advertising measure by the hotel.

For any disputes arising from this contract and its fulfillment, to the extent permitted by law, the registered office of the hotel (Zeltingen-Rachtig) shall be deemed to have been agreed.

Should one of the above provisions be invalid, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the invalid provision.

The German version of our General Terms and Conditions takes precedence over the English version. In case of doubt, the German version shall be considered the reference.

General Terms and Conditions (GTC)
Restaurant at Hotel Deutschherrenhof – Zeltingen-Rachtig

Scope of Application

These General Terms and Conditions apply to the use of gastronomic services at the restaurant of Hotel Deutschherrenhof, in particular to table reservations, menu agreements, events, and special services.

Reservations and Conclusion of Contract

A contract is concluded upon confirmation of a table reservation or the agreement of a service by the restaurant. This may be done verbally, in writing, or electronically.
Reservations are valid only for the agreed time and number of persons. In the event of a delay of more than 15 minutes without prior notice, the table may be reassigned.
For special services (e.g. menu agreements, events), individual arrangements apply as the contractual basis. For groups of 10 persons or more, a deposit may be required.

Services and Prices

The scope of services results from the reservation confirmation or the agreements made. Special services (e.g. flowers, cake, technical equipment) will be charged separately.
All prices include service charge and statutory value-added tax. Local charges such as tourism taxes are only relevant if legally required.
In the event of changes to the statutory value-added tax, we reserve the right to adjust prices. For reservations made more than 6 months in advance, price changes may occur.

Cancellations

Table reservations in the à la carte restaurant:

Up to 4 hours before the appointment: free of charge
Thereafter or in case of no-show: flat cancellation fee of €25 per person

Groups and events (e.g. culinary events, harvest season, etc.):

Up to 7 days before the appointment: free of charge
Up to 3 days before the appointment: 50% of the menu price per person
Thereafter: 80% of the menu price per person
In case of no-show: 100% of the menu price per person

Vouchers

Vouchers are valid only after receipt of payment in the business bank account. The original voucher must be presented upon redemption. If it is not presented, the service may be refused unless alternative proof of entitlement is provided.

Food and Beverages Brought by Guests

Bringing own food and beverages is not permitted. Exceptions (e.g. wedding cake) require prior agreement. The restaurant assumes no liability for food brought by guests.

Liability

The restaurant is not liable for clothing, bags, or valuables unless gross negligence or intent is involved. Guests are liable for any damage they cause.

This policy is an integral part of these GTC.

Final Provisions

The place of jurisdiction and performance is – insofar as legally permissible – Zeltingen-Rachtig.
Should any clause of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. Only the German version of these GTC shall apply.
